OVERVIEW: We represent individuals and businesses, including foreign clients, primarily in lawsuits, arbitrations, and investigations pending in New York, New Jersey and elsewhere in the United States. PRACTICE AREAS: CIVIL LITIGATION IN COMMERCIAL DISPUTES We represent plaintiffs and defendants at trial in simple to complex contract disputes, for example, over commercial leases, employment, finder fees, partnerships, and unpaid commissions and professional fees. Our firm recently prevailed on a Motion for Summary Judgment rescinding a 10-year commercial lease in midtown Manhattan, where the Court also ordered the landlord to return the advance rent and security deposit. The decision of the New York County Supreme Court was affirmed on appeal by the Appellate Division, First Department. FEDERAL AND STATE INVESTIGATIONS AND LAWSUITS We represent persons asked to testify and targeted in government investigations, civil and criminal, initiated, for example, by the IRS, SEC, FTC, EPA and FINRA. Where there are potential conflicts, often we conduct such representation as part of the team of counsel representing the employer and its staff. CONTRACTS - DRAFT, REVIEW, NEGOTIATE Our work for clients has covered commercial leases, executive severance agreements, and employment agreements. We draft and review drafts of contracts mindful of covering issues that could lead to costly litigation. CREDITOR BANKRUPTCY - CLAIMS, ADVERSARY PROCEEDINGS AND VOIDABLE PREFERENCE ACTIONS We represent creditors who have claims in bankruptcy, face voidable preference actions to return money to the debtor, and defendants in adversary proceedings. Our firm has used statistical analysis to successfully mitigate the amount of claw-backs in voidable preference actions.
